The paper starts with a review of the substantial and formal public international law relating to river transport. The paper reviews legal issues that can pose a burden to the further development of IWT: conditions of freedom of navigation, equality of treatment, fair competition and reciprocity. The paper concludes with recommendations and/or solutions as regards the confirmation of the principle of freedom of navigation as a basic concept under EC Law and the harmonization of the content and interpretation of the principle of freedom of navigation, in harmony with the basic principles of EC law (i.e. equality of treatment in all matters, freedom of international transport and cabotage, freedom of contracting and pricing, fair and workable competition). Furthermore, recommendations are given for the standardization of social and labour and tax conditions, safety regulations, creation of a common private and administrative law, and the set-up of international instruments in order to supervise the observance of common provisions.
